Terms of Service

These Terms of Service ("Terms") govern your access to and use of FragMates ("we", "us", or "the platform"). By creating an account or using the platform, you agree to these Terms. If you do not agree, do not use the service.
1. The service
FragMates provides an online venue for customers to discover and book sessions with independent freelancers ("teammates"). We are not a party to the agreement between a customer and a freelancer for any given session unless we expressly say otherwise in writing.
2. Accounts
You must provide accurate information and keep your login secure. You are responsible for activity under your account. We may suspend or terminate accounts that violate these Terms or create risk for others.
3. Teammates and applications
Becoming a teammate is subject to our review and approval. We may approve, request more information, or reject applications at our discretion. Approved teammates must complete onboarding and comply with platform rules.
4. Payments
Prices, taxes, and payment processing may be shown at checkout or in-product. Third-party payment processors handle card and wallet data according to their own terms and privacy policies. You authorize us and our processors to charge amounts you agree to when you place or accept an order.
5. Conduct
You agree not to:
- Harass, threaten, defraud, or discriminate against others.
- Upload malware, attempt unauthorized access, or disrupt the service.
- Circumvent fees, abuse promotions, or manipulate ratings or discovery.
- Use the platform for unlawful activity or in violation of third-party rights.
6. Content you provide
You retain ownership of content you submit, but you grant us a limited license to host, display, and process it as needed to operate the platform (for example, profiles, chat, and application materials).
7. Disclaimers
The service is provided "as is" to the fullest extent permitted by law. We do not guarantee match quality, outcomes of sessions, or uninterrupted availability. Freelancers are independent; their statements and performance are their responsibility.
8. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the platform. Our aggregate liability for claims relating to the service is limited to the greater of (a) the fees you paid us in the twelve months before the claim or (b) one hundred U.S. dollars (USD $100), unless a mandatory law requires otherwise.
9. Changes
We may update these Terms from time to time. We will post the revised Terms with an updated date. Continued use after changes constitutes acceptance unless applicable law requires additional notice or consent.
